Where businesses have suffered loss due to the anti-competitive behaviour of suppliers or competitors they may choose to bring private damages actions rather than relying on competition authorities to investigate. In addition, where the competition authorities have found that a business has breached competition rules, it is now possible in the UK to bring follow-on actions for damages in the Competition Appeal Tribunal.
